Request a Certificate of Compliance

A Certificate of Compliance, also known as a compliance letter, provides confirmation that all tax returns and taxes administered by the SCDOR have been filed and paid by a taxpayer. 

A compliance letter:

  • certifies compliance for businesses as well as individuals.
  • is valid for 30 days from the date it is issued.

Am I eligible for a compliance letter? 

We can only issue compliance letters to South Carolina taxpayers. If you do not have a filing history in South Carolina, you are not eligible for a compliance letter. 

To request a compliance letter, you will need to:

  • complete the Certificate of Tax Compliance Request Form (C-268).
  • pay a nonrefundable fee of $60. 

Note: Your request may be approved or denied.

Successfully submitting your request

You have two options to request a compliance letter.

  • Recommended: Submit your request on MyDORWAY, our free online tax portal.
    1. Log in to your MyDORWAY account.
    2. Select the More tab, then click Make a Certificate of Compliance Request.
  • You may also submit the C-268 paper form by email, fax, or mail.

Requirements for submitting a request:

  • Include the taxpayer’s name and SSN/ITIN/FEIN.
  • Complete all fields on the C-268 form. Do not leave fields blank.
  • The Power of Attorney form (SC2848) must list compliance in Section 3 and must be signed by an owner, officer, or Personal Representative.
  • The taxpayer or authorized individual must sign and date the C-268 form.
  • Include the taxpayer’s name and EIN on each check or money order submitted.

Requests will not be processed until the above requirements are met.

After you submit your request

Please allow a minimum of ten business days, excluding weekends and state holidays, for the SCDOR to process your request. You will receive a response of denial or approval. 

  • If you receive an approval letter, no additional action is required with the SCDOR.
  • If you receive a denial letter, follow the directions on the letter to become compliant.
    • If you do not respond within 30 days of the date the denial letter is issued, your request is considered withdrawn.
    • If your request is withdrawn, a new Certificate of Tax Compliance Request Form and $60 fee will be required to make another request.
